NewDelhi,Dec12: TheDelhiPoliceonMondayopposedintheSupremeCourt docketconmanSukeshChandrashekhar’spleaforshiftinghimtoapenal advancedoutsidethenationalcapital,callinghima”desperateandcraftyprison”whohasnoadmireforlaw.
ItallegedChandrashekharisabusingthedirection ofoflawtoadditionalhiscrimesyndicateandlevellingbaselessallegationsin opposition totheDelhiPoliceandthecentralauthorities.
AbenchofJusticesAjayRastogiandBelaMTrivedi,whichishearingapleabyChandrashekharandhiswifeLeenaPauloseattempting forswitchtoanyprisonoutsideDelhiowingtoallegedthreattotheirlives,wasurgedbyrecommendRajatNair,appearingfortheCentre,thattheDelhiPolicehasfiledanaffidavitonhispetition.
SeniorrecommendRBasant,representingChandrashekhar,talked abouthewouldindulge intoafileaacknowledgetotheDelhiPolice’saffidavitwhichwasservedtothem”attheclosingminute”.
ThebenchpostedthetopicforadditionalhearinginJanuaryandaskedBasanttofilearejoinderaffidavit.
Initsaffidavit,theDelhiPolicetalked about,”Thattheaccused/petitionerquantity-1isdesperateandcraftyprison,concernedinvariedoffences.Itisobviousthathehasnoadmireforthelawanddoesno longerhesitatetodisobeytheordersofeventheSupremeCourt docketofIndia.”Ittalked aboutChandrasekhar,whoisinjudicialcustodysince2017,hadmadesuchclaimsintheprevious,too,withthesoleaimanddesigntobereadytoproperaswitchoutofDelhiasheisunabletotraipsehiscrimesyndicatefrominternaltheprison.
“Thatthepetitionerisabusingthedirection ofandaugustdiscussion boardandclear upbeneathArticle32oftheConstitutionofIndiainrepeattoadditionalhisprisonsyndicateandinrepeattoenactthesame,baselessallegationsfetchbeenlevelledin opposition totherespondents,”ittalked about.
TheFinancialOffencesWingofDelhipolicewhichisinvestigatingthecasesin opposition toChandrashekhartalked abouthehasover and overdedicatedoffencesincludingmoneylaunderingat some level ofhisincarcerationbysubvertingthesimplysystemandpenal advancedconceptswiththebackofhisdataoftechnologyandhisabilitiestoconother folks.
“ItissubmittedthatthereisfullynothreattothelifestylesofthepetitionersinternaltheTihar/Mandoliprisonandthepetitionerissimplestmakingupanexcusetorepeathismodusoperandiinsomeotherpenal advancedthe establishthepenal advancedofficerswouldno longerbeacquaintedwithhisantics,”ittalked about.
TheDelhipoliceadded,”ItisalsopertinenttomentionherethataccusedSukeshChandrashekharisno longersittingsilentlyeveninjudicialcustody.Totalthreeseparateprisoncasesfetchbeenregisteredin opposition tohimwhereashewasrunninginjudicialcustodylengthandineachcase,hetriedtoarrangethecompletesystemanddisobeythelaw…”.
ReferringtovariedprisonincidentsinwhichChandrashekharhasbeenallegedlyconcerned,theDelhipolicetalked aboutithasprimafacieemergedthattheaccused,at some level ofhispolicecustodyremandin2017,misusedthephoneofaconstableformakingacalltoaspecialassumeimpersonatinganapexcourtassumeandaskedhimtogranthimbail.
ItallegedheevenimpersonatedanIASofficer,workingastheprivatesecretarytoUnionministerforLegislationandJusticeaskingtheTamilNaduspecialpolicecommandanttoprolongfavourtohim.
Policeclaimeddespitebeingincustody,hehasbeenover and overstumbled onutilizingmobilephones,impersonatingexcessiveratingauthoritiesofficers,andextortinghundredsofcroreofrupees.
“Thedemonstratepetitionattempting forhisswitchtobut some otherpenal advancedisbutbut some otherploytorepeatthesamemisdemeanorsinbut some otherprisonfacilityandexploittheloopholesthe establishtheprisonauthoritiesareno longeracquaintedwithhisinnovativesolutionsofcon-manship,”ittalked about.
Theaffidavittalked abouttheTiharPrison/MandoliPrison(DelhiPrisons)hasalreadydeployedcorrectandsufficientmeasuresandmechanismtocheckandadmireanyprobabilityoftheaccusedrepeatinghismisdemeanoursfrominternaltheprison.
ItaddedtheMandoliprisonhasalsotakenstepstothwartanyfutureprobabilityofmisuseofprisonfacilities.
“Foranynewprisonstoestablishinspacesamemeasuresoreventoadvancetophraseswiththesophisticatedwayofconmanshipbythepetitionerquantity-1(Chandrashekhar)willfetchtimeandtransferringthepetitionerstoanyotherpenal advancedwouldbedangerousasthepetitionersquantity-1isseeminglytorepeatthesamemischiefandoffencesfrominternaltheprisonashehascarried outonrepeatedeventsintheprevious,”ittalked about.
Theaffidavittalked aboutallstepsfetchbeentakentocrawltheloopholesinMandoliPrisonandsolidmeasuresinitiatedin opposition tothecolludingofficers.
“Theprisonauthoritiesfetchalsoundertakenthatallmeasureswillbetakenforthesecurityofthelifestylesofallinmates,”ittalked about,addingthedemonstratepleahasbeenmovedsimplestwiththe”ulteriormotives”togleanhim(Chandrashekhar)outoftheMandoliprison,soastobereadytofetchtheprobabilitytosetuparecentnexuswithprisonofficersin various locationsinrepeattotamperwithproof,impact/threatenwitnessesandadditionalhisorganisedcrimesyndicate.

ChandrasekharwasarrestedinApril,2017forallegedlytakingmoneyfromAIADMKleaderTTVDinakaranonthepretextofserving tohimgrasp’two-leaves’ imageforhisfactionafteradamage upintheglean together.
